Frogs

In our backyard, we have two ponds...

this one

and this one.

Usually, several time during the summer, we have waves of frogs come to serenade us with their LOUD croaking. Of course, they don't start their entertainment until around 10:oo pm. Doc20 will go into the backyard, armed with a pool net and flashlight, braving the mosquitos, to catch and send to frog heaven the current crop of croakers. I know this is not very "eco-friendly" and they do eat bugs, but earlier this week he had a record catch for one night. You try sleeping with FIFTEEN frogs calling their girl friends just outside your bedroom window.

  1. After many years of dealing with operations, liability mitigation, and regulators (and especially after a day full of it)...I thought I think this could easily be considered a serious matter and wanted to offer some food for thought. (Said with all the legal muster an MBA can dredge up, LOL)

I think legally speaking the ponds might be considered an "attractive nuisance," thereby making you the liable party in creating an environment which entices said frogs to visit. As a result, the frogs could not be considered liable for a) being frogs, b) doing what frogs do, and c) for doing in the environment which is conducive to said croaking activities. Don't even get me started on the other potential liabilities...frog abuse/homocide, unsafe work environment for frog removal specialist. I also haven't even started on the regulators...OSHA, Department of Environmental Quality, Department of Wildlife, Department of Fisheries, City Auditors, and PETA.
